Terms of Service

The deal, plainly.

These Terms govern your use of the Sunza website and, once released, the Sunza app. Please read them — the part about weather forecasts and packing suggestions matters most.

1. Agreement

These Terms are a contract between you and Oliver Cameron, sole trader, France (“Sunza”, “we”, “us”), governing your use of the Sunza website and app (together, the “Service”). By using the Service you agree to these Terms. If you don't agree, please don't use the Service.

2. The Service

Sunza is a weather-aware packing assistant. Today, the website lets you join a waitlist. When released, the app builds packing lists from weather forecasts and, optionally, from clothes you add to an on-device wardrobe. Sunza is provided for your personal, non-commercial use.

3. Eligibility

You must be at least 15 years old to use the Service. If you are aged 15 to 17, a parent or guardian must consent to your use. Any future paid features are restricted to users aged 18 or over (or taken out by a parent or guardian), reflecting French rules on the contractual capacity of minors.

4. The waitlist

If you join the waitlist, you consent to receive a limited number of emails about Sunza and can unsubscribe at any time. See our Privacy Policy for how we handle your email.

5. Acceptable use

You agree not to: use the Service unlawfully; interfere with or disrupt it; attempt to gain unauthorised access; or copy, scrape or reverse-engineer it except where the law permits.

6. Intellectual property

The Service — including its design, text and branding — belongs to Sunza and is protected by law. We grant you a personal, revocable, non-transferable licence to use the Service (this website, the Android app, and your on-device data) as intended. This licence is not, and is not intended to be, a separate end-user licence agreement for the iOS app — see clause 10. Anything you add in the app (such as your wardrobe) remains yours.

7. Weather data & packing suggestions — please read

Sunza's forecasts come from third-party weather providers, and its packing suggestions are guidance only. Weather is uncertain and forecasts can be wrong. You are responsible for your own packing decisions and for checking conditions relevant to your safety, health and travel. Sunza is not liable for decisions made in reliance on its forecasts or suggestions.

8. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law. We don't guarantee it will be uninterrupted, error-free, or that forecasts will be accurate.

9. Limitation of liability

To the fullest extent permitted by law, Sunza will not be liable for indirect, incidental or consequential loss, or for loss arising from your reliance on forecasts or suggestions. Nothing in these Terms limits liability that cannot be limited by law.

Your legal guarantees (EU / French consumers). The disclaimers and limitations above do not affect your mandatory statutory rights. In particular, as a consumer you benefit from the legal guarantee of conformity for digital content and services (garantie légale de conformité, Articles L224-25-12 et seq. of the French Code de la consommation) and the guarantee against hidden defects (garantie des vices cachés, Article 1641 of the Code civil). These guarantees apply regardless of anything in these Terms.

10. App stores (Apple & Google)

When you download the app from the Apple App Store or Google Play, your use is also subject to that store's terms.

iOS. We have not supplied a custom end-user licence agreement to Apple; the licence field in App Store Connect is left at its default, so Apple's Licensed Application End User Licence Agreement (the “Standard EULA”) governs your licence to use the iOS app. Where these Terms and Apple's Standard EULA conflict on the scope of that licence, Apple's Standard EULA governs for iOS. Android. Google Play provides no default EULA, so for the Android app these Terms are themselves the governing licence.

Apple and Google are not responsible for the app or for providing support for it. For iOS, Apple and its subsidiaries are third-party beneficiaries of your licence and may enforce it.

11. Changes

We may update these Terms as the Service develops. Continued use after a change means you accept the updated Terms; we'll update the effective date above.

12. Governing law & your courts

These Terms are governed by French law, without prejudice to the mandatory consumer-protection rules of your country of residence in the EU. If you are an EU consumer, you keep the right to bring proceedings in the courts of your own member state and to rely on the mandatory consumer protections of your home country; nothing here removes those rights.

13. Consumer mediation

If we can't resolve a dispute directly, you have the right, as a consumer, to use a consumer mediator (médiateur de la consommation) free of charge (Articles L611-1 et seq. of the French Code de la consommation). 14. Cancellation & withdrawal

The waitlist is free and you can leave it at any time by unsubscribing. If Sunza later offers paid digital content or services, EU consumers will have a 14-day right of withdrawal (Article L221-18 of the Code de la consommation), except where you expressly ask for the service to begin immediately and acknowledge losing that right, as the law allows.

15. Termination

You can stop using the Service at any time. We may suspend or end your access if you breach these Terms or where needed to protect the Service, and we may discontinue the Service; where you hold a paid entitlement, we'll handle any refund due under your legal guarantees.

16. Third-party links

The Service may link to third-party sites or services (for example a weather-data provider or an app store). We don't control them and aren't responsible for their content or practices; their own terms and privacy notices apply to your use of them.

17. Mentions légales (legal notice)

In accordance with Article 6-III of French Law No. 2004-575 (LCEN), the site's publisher and host are identified below.
